Women Implanted with Transvaginal Mesh in Washington State are eligible to submit a Claim for payment from the Washington State Transvaginal Mesh Fund.

The Court approved a second settlement with C.R. Bard in a Consent Decree filed on September 24, 2020, through which the Attorney General’s office obtained an additional $2.38 million. Both the funds received from Johnson & Johnson and the funds received from C.R. Bard were included in the initial distribution payments made in January 2021.

The Court approved a third settlement with Boston Scientific in a Consent Decree filed on March 23, 2021. A second claim filing period, accepting new claims, and a second distribution are anticipated in the near future. If you previously submitted a claim, we already have your identity and information, and you DO NOT need to do anything further. If you submitted an eligible claim in the first claim filing period that ended in June 2020 and have not received your payment, please email the Fund Administrator at info@WAAGMeshSettlement.com with any questions regarding payment, or to request a reissue of your payment.

In May of 2016, the Washington State Attorney General sued Johnson & Johnson for deceptively advertising its transvaginal mesh implants.  In 2019, Johnson & Johnson paid the Washington Attorney General $9.9 million to resolve this lawsuit. From that settlement, the Washington State Attorney General has created a fund for women who received transvaginal mesh implants in Washington.

If you were implanted with transvaginal mesh to treat stress urinary incontinence or pelvic organ prolapse in Washington State, you can file a claim with the Washington State Transvaginal Mesh Fund. You can make a claim if you have had a transvaginal mesh implant made by any manufacturer, even if you have not had complications or monetary loss as a result of the implant. You may file a claim even if you have received money from another transvaginal mesh lawsuit.

If you want to participate in the Fund, you must file a claim by mail or online. The claims process is simple. You do not need to prove you had adverse reactions or side effects to be eligible for a payment.

February 20, 2024: Claim Forms are mailing on February 20, 2024 to those that requested them. If you submitted a Claim and received a payment from the previous distribution, please DO NOT submit another claim form, you will automatically be included in the current distribution. If you did not receive a payment but believe you are eligible, you must submit your claim online, or mail it by April 20, 2024.

March 23, 2021:  A Press Release was issued by the Washington State Attorney General’s office on this date, announcing that a resolution with Boston Scientific Corp. regarding its transvaginal mesh devices has been reached.  An additional claim filing process will be announced in the near future.  The next claim filing process will be open to women who have received transvaginal mesh implants in Washington State, which were implanted to treat stress urinary incontinence or pelvic organ prolapse. If you have previously submitted a claim, we already have your identity and information, and you do not need to do anything further.
